85 Dr. Upton asked the Minister for Health and Children the steps, if any, he can take to ensure that no smoking regulations are observed on services provided by Dublin Bus. [2164/00]

107 Dr. Upton asked the Minister for Health and Children his views on ensuring that no smoking regulations are observed on services provided by Dublin Bus. [2165/00]

I propose to take Questions Nos. 85 and 107 together.

The Tobacco (Health Promotion and Protection) Regulations, 1995, prohibit smoking on all public service vehicles owned or operated by Dublin Bus. Primary responsibility for compliance with the regulations is a matter for the manager or person in charge of the facility concerned. Breaches of the regulations should be brought to the attention of the manager or person in charge. If the response is not satisfactory the environmental health department of the appropriate health board should be notified.

It is in everyone's interest that the prohibition on smoking on bus services is observed to ensure protection of passengers against the harmful effects of environmental tobacco smoke.
