147 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 headage and premia in view of the fact he has submitted evidence of his entitlement to claim the holding; and if he will confirm details of both herd owners if a dual claim error has arisen. [4241/00]

As stated in my reply to parliamentary Question No. 297 of 26 January 2000, one of the parcels claimed by the person named in his 1999 area aid application overlaps with a parcel of land claimed by another applicant.

At the same time a dual claim has also been determined on a separate parcel included in the applicant's 1999 area aid application. The herd owners involved in each instance are the same and have been written to, with a view to resolving the problem. Both herd owners have now responded, with both claiming the right to the dual claimed parcel and the overlapping parcels. However, neither herd owner included legal evidence for their claim. Consequently both herd owners have again been contacted requesting them to forward legal proof of their claim, and a response is awaited.

An additional overclaim had also been identified on one of the land parcels claimed by the person named in 1999. Maps issued to him and he had also been informed of the extent of this overclaim.

No payments can issue until all these matters have been satisfactorily resolved. The details of the other applicant involved in the dual claim can not be disclosed as each area aid application is treated confidentially.
