Vol. 515 No. 2

Written Answers. - Registration of Title.

Bernard J. Durkan

Ceist:

213 Mr. Durkan asked the Minister for Justice, Equality and Law Reform the position in relation to the transfer of lands (details supplied) in County Kildare and if he will make a statement on the matter. [5732/00]

I am informed by the Registrar of Titles that dealing No. D99KW11260B – Folio Nos. 3741 and 2269 – lodged on 2 November 1999 and Dealing No. D99KW10161T – Folio Nos. 2282 and 2261 – lodged on 4 October 1999 refer to applications under section 49 – i.e. acquisition of title by virtue of long possession – of the Registration of Title Act, 1964. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, can take some time to process.

I am further informed that queries issued to the applicant's solicitors on 5 January 2000 and the Land Registry await a reply. These applications cannot proceed until the queries have been satisfactorily resolved. It is not possible to estimate a completion date for the application concerned at this stage.

However, I can assure the Deputy that on receipt of a satisfactory response from the lodging solicitors involved, the matter will be completed by the Land Registry without delay.
