238 Mr. Kenny asked the Minister for Agriculture, Food and Rural Development the reason he has refused cattle headage payment in respect of 1999 to a person (details supplied) in County Mayo and if he will make a statement on the matter. [8922/00]

The person named is not the registered herdowner of the herd number quoted. The registered herdowner applied on 43 animals under the 1999 cattle headage scheme. At an inspection carried out on 12 July 1999 one of the animals applied on was absent, one animal did not have a passport and 13 animals were not recorded in the herd register. The registered herdowner was advised in writing on the day of the inspection that she had not complied with clauses 13 and 32 (b) and (d) of the terms and conditions governing the 1999 cattle headage scheme. The registered herdowner was invited to submit any additional information on the inspection to my Department within seven days. My Department received a reply from the registered herdowner on 15 September 1999 and while this information was taken into account when considering the appropriate penalty to apply to her application, my Department wrote to her on 15 November 1999 advising that no grants were payable under the 1999 cattle headage scheme. She was given the opportunity to have this decision reviewed by writing to my Department within 21 days setting out any facts which she wished to put forward to support her case but no reply was received. I am now arranging to have the case reviewed again and my Department will be in contact with the herdowner as soon as the review is completed.
