32 Mr. J. O'Keeffe asked the Tánaiste and Minister for Enterprise, Trade and Employment if her attention has been drawn to the special circumstances surrounding the loss of a fishing vessel (details supplied) on 31 July 1997 resulting in no insurance moneys being paid; if she will put in place a compensatory fund to cover such fishing vessel losses; and if she will make a statement on the matter. I can confirm that our Department has received correspondence about the loss of this fishing vessel and the subsequent difficulty experienced by the owners of the vessel in obtaining payment.

The information which this Department has to hand indicates that the insurance for the vessel was placed with a company which did not have authorisation to write marine business in this country. The case has been referred to the Garda Bureau of Fraud Investigation and to the Serious Fraud Office in the UK.

As stated previously, I cannot stress too much the importance of placing insurance with or through EU authorised companies. No direct life or non-life insurers may operate within the EU, unless they have authorisation to do so. Our Department can quickly confirm to anyone seeking insurance whether a company is authorised within the EU.
We have no plans to put in place a compensation fund that would cover such losses.
