383 Mr. Quinn asked the Minister for Agriculture, Food and Rural Development the proposed statutory instruments being prepared in, or under the auspices of his Department; the proposed effect of each; and if he will make a statement on the matter. [19620/00]

384 Mr. Quinn asked the Minister for Agriculture, Food and Rural Development the Acts or sections or other provisions of Acts under the auspices of his Department or for the commencement of which his Department is responsible which have not commenced by reason of the fact that a commencement order has not been made; if he has any plans to make such an order in each case; if so, when; the reason for the failure in each case to make such an order to date; and if he will make a statement on the matter. I propose to take Questions Nos. 383 and 384 together.

The following proposed statutory instruments are being prepared by my Department:

1. National Beef Assurance Scheme Act 2000Regulations being prepared under this Act will provide statutory basis to the cattle herd reconciliation exercise planned for 31 December 2000. The purpose of this exercise is to confirm the extent of the current population on the CMMS database and to determine the location of these animals in a particular herd on 31 December 2000. The effect of these regulations will be to oblige cattle herd owners to verify and return herd profile statements previously issued to them.

2. European Communities (Wine) Regulations, 2000The purpose of this statutory instrument is to confer powers of entry on authorised officers and to provide for penalties for breaches of the provisions of Council Regulation (EC) No. 1493/99 of 17 May 1999 on the common organisation of the market in wine. Council Regulation 1493/99 automatically has the force of law here, but national legislation – secondary – is required to enable it to be policed.

3. European Communities (Marketing of Cocoa and Chocolate products intended for human consumption) RegulationsThe purpose of this statutory instrument is to transpose directive 2000/36/EC of the European Parliament and of the Council relating to cocoa and chocolate products into Irish law. The deadline for the implementation of this directive is 3 August 2003.

4. An Bord Bia (Levy) RegulationsThe purpose of this statutory instrument is to provide that the stamps, by which the export levy under section 37 of An Bord Bia Act, 1994, is payable, are in convenient euro amounts.

5.European Communities (Approval and Registration of dealers and dealers premises) RegulationsThe purpose of this S.I. is to give full effect to the provisions of Council Directive 97/12/EC of 17 March 1997, Council Regulation (EC) No. 820/97 of 21 April 1997, Commission Regulation (EC) No. 2628/97, Commission Regulation (EC) No. 2629/97, Commission Regulation (EC) No. 2630/97, all of 29 December 1997 and Commission Regulation (EC) No. 494/98 of 27 February 1998 in so far as they refer to dealers. Specifically, the statutory instrument provides for the approval and registration of dealers and dealers' premises, the revocation, suspension or refusal to register a person or premises and sets out the obligations and responsibilities of dealers and the penalties applicable to contravention of the regulations.
6. My Department is currently preparing a statutory instrument relating to the labelling of beef and beef products. The statutory instrument will transpose Regulation (EC) No. 1760/2000 of the European Parliament and of the Council and will repeal S.I. No. 31 of 1998. The effect of its introduction will be to make it compulsory that all beef sold will be labelled with certain information which will provide the consumer with information enabling the beef to be traced back to the animal or group of animals from which it was derived.
Part 5 of the National Beef Assurance Scheme Act was commenced with effect from 29 May 2000. A commencement order for sections 20 and 21 of the Act will be made next month. The remaining sections of the Act will be commenced once the arrangements for inspection and certification of farms under the Act have been finalised in consultation with the industry.
