337 Mrs. B. Moynihan-Cronin asked the Minister for Health and Children if he has considered the recommendation contained in the Oireachtas Joint Committee on Health and Children report on smoking which expressed the view that individuals taking action against the tobacco industry should not be obstructed by the statute of limitations if he has reached a conclusion in this regard; and if he will make a statement on the matter. Minister for Health and Children (Mr. Martin):

I have not reached any conclusions with regard to the recommendation regarding the statute of limitations contained in the Oireachtas Joint Committee on Health and Children report on smoking. I am advised that there are possible legal and constitutional implications with regard to any alteration to the Statute of Limitations 1957 and 1991.
