107 Mr. Stanton asked the Minister for Justice, Equality and Law Reform further to Parliamentary Question No. 396 of 8 November 2000, the total number of persons supervised in 1999 and to date in 2000 under the community service scheme; the plans he has to expand this scheme; and if he will make a statement on the matter. [27162/00]

At 1 January 1999, there were a total of 1,216 persons subject to a community service order under the supervision of the Probation and Welfare Service. The Probation and Welfare Service was notified of the making of a further 1,342 community service orders by the courts during the calendar year 1999 and all of these orders are either being implemented by the Probation and Welfare Service or have been subject to revocation. It should be noted that under the Criminal Justice (Community Service) Act, 1983, persons who have a community service order imposed on them by the courts have 12 months from the date of the order to complete the number of hours work specified in the order.

At 1 January 2000, there were a total of 1,351 persons subject to a community service order under the supervision of the Probation and Welfare Service. A further 600 community service orders were notified to the Probation and Welfare Service in the period from 1 January to 30 June 2000 and 388 of these orders have commenced implementation by the service.

The making of a community service order is entirely at the discretion of the Judiciary, and the number of orders made over the last four years have been fairly consistent. If however, the courts were to have recourse to orders made under section 3 of the Criminal Justice (Community Service) Act, 1983 more frequently, then any necessary extra resources required by the Probation and Welfare Service will be provided by my Department.
