39 Mr. Callely asked the Minister for the Marine and Natural Resources if his attention has been drawn to unauthorised breaching of Dublin Bay foreshore by Dublin Port Company in recent times; the penalties that apply in such instances; and if he will make a statement on the matter. [26442/00]

I confirm that my attention was drawn to two instances of unauthorised works by the company on its own foreshore. The works have ceased and the company has sought my consent as required under the Foreshore Acts. The company had, through an oversight, overlooked seeking my consent before proceeding.

The public consultation process in relation to the first was initiated by the company on 11 October by advertisement in the national press, as indicated in my reply to Question No. 252 on 7 November. The current position is as indicated in that reply.

The necessary public consultation process in relation to the second will be initiated by the company in the near future by advertisement in the national press.

If I refuse to consent in either case, the works would have to be completely undone and the foreshore restored to its original state.

The question of legal proceedings does not arise.
