Ceist:

103 Mr. O'Shea asked the Minister for Justice, Equality and Law Reform if he will urgently review the case of a person (details supplied) in County Waterford who is seeking asylum; and if he will make a statement on the matter. [27108/00]

The person referred to arrived in the State on 19 June 2000. Her claim was determined initially following an interview on 25 July 2000 and her application for refugee status was turned down. She appealed this decision on 30 August 2000 through her legal representatives. The Independent Appeals Authority recommended that the appeal be refused and the person referred to was informed of this decision in writing on 25 October 2000. At that time, the person referred to was informed that it was proposed to make a deportation order in respect of her and she was given the opportunity to either leave the State voluntarily, consent to a deportation order or to make representations as to why she should not be deported.

Representations have been received from her legal representatives and from several other individuals. It is now my intention to give consideration to the making of a deportation order having regard to the provisions of section 3 (6) of the Immigration Act, 1999, subject, of course, to the prohibition of refoulement as set out under section 5 of the Refugee Act, 1996.
