127 Mr. J. O'Keeffe asked the Tánaiste and Minister for Enterprise, Trade and Employment whether more than one trader can hold registration certificates for identical or similar names under the Registration of Business Names Act, 1963; and when new legislation will be introduced to update this Act. [27423/00]

The Registration of Business Names Act, 1963, obliges limited liability companies, individuals and partnerships to register business names with the Registrar of Companies if trading under a name other than their own. The purpose of the Act is one of business and consumer transparency, namely, to ensure that those using business names are readily identifiable. Registration does not confer proprietorial rights to a particular name. Registration simply puts on record the proprietors of the business.

My Department invited observations on proposed changes to the current business name code in the early summer. The responses received are currently being evaluated.
