135 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if he will intervene on behalf of a person (details supplied) in County Sligo and waive the penalties applied under his beef premium; if he will release his 2000 cattle headage payment; and if he will make a statement on the matter. The person named applied for special beef premium on a female animal on 9 March 2000. He later contacted his local office to have his cattle identity card amended from male to female. He did not notify the special beef unit of the error to his application, as required under the terms and conditions of the scheme.

On discovery of the special beef application on a female animal, the applicant was notified and a reduction penalty applied to his application. Following appeal the reduction penalty was removed. Payment for the balance due will issue in the next two to three weeks.

The 2000 area aid application for the person named has been fully processed with no outstanding errors, and the area for payment purposes has been determined at 11.51 hectares.

The person named was paid his full entitlement of £785.77 under the 2000 cattle headage scheme on 29 November 2000. While this payment was not subject to any penalty on the animals applied on it was subject to a forage area restriction in accordance with clause 27 of the terms and conditions governing the scheme. This clause provides that an applicant qualifying for disadvantaged areas beef cow headage grants may not receive more than £89.62 per hectare of the total forage area and not more than £55.99 per forage hectare in respect of headage grants on other cattle.
