Written Answers. - Remission of Fines.

346 Mr. Quinn asked the Minister for Justice, Equality and Law Reform the number of fines which have been remitted under the Criminal Justice Act, 1951 since the decision of the High Court in the case taken against the Minister by a judge (details supplied) of the District Court. [28598/00]

Since the High Court judgment on 28 April 1995, 7,109 applications under the Criminal Justice Act, 1951, have been finalised. Full remission of fines was granted in respect of six petitions, while a further 23 special applications from prosecuting authorities, originating from prosecutions in error, also resulted in the full remission of fines. The applications contained 38 fines totalling £2,805.

In addition, offers of partial mitigation were made in response to 80 other petitions. However, an offer of partial mitigation does not involve the full remission of fines but rather that the outstanding balance is remitted if a nominated portion of the penalty is paid within a specified period.
