112 Mr. Durkan asked the Minister for Finance if, further to Parliamentary Question No. 101 of 30 November 2000, he considers the offer of £5,000 in lieu of the proposed forfeiture of a deposit of £10,000 to be a reasonable offer; if he will authorise the proposed sale to proceed on foot of original offer and terms; and if he will make a statement on the matter. This case relates to the sale of a property in Shankill. The deposit of £10,000 was forfeited in accordance with the terms of a contract entered into by the person concerned due to his failure to complete the transaction despite being given every opportunity to do so. The offer to refund half of the deposit on an ex gratia basis is reasonable.

Market conditions have changed considerably due to the long lapse of time since the original sale and it is not, therefore, possible at this stage to proceed with the sale on the original terms.
