106 Mr. Neville asked the Minister for Agriculture, Food and Rural Development the waiting period for determination of appeals of decisions of his Department. [7322/01]

The headage and premia appeals unit, which deals with appeals relating to the livestock and arable aid schemes, has set itself a target of processing within three months all but the most complicated and intractable of appeals. The current turnaround time is three months.

The REPS appeals committee deals with appeals against non-compliance penalties arising under the rural environment protection scheme. Normally, the average processing period for REPS appeals is three to four months. However, the considerable demands placed on the relevant officials by the launch of the new REP scheme has led to some unavoidable delays in processing appeals. Additional appeals committee meetings are being scheduled in order to have outstanding appeals processed.

107 Mr. Neville asked the Minister for Agriculture, Food and Rural Development when an appeal for upgrade in milk calculation to have it based on 1999 will be determined for a person (details supplied) in County Limerick. [7323/01]

The appeal is under active consideration and a decision will be taken shortly. The person concerned will then be informed immediately.
