472 Mr. Ring asked the Minister for Social, Community and Family Affairs when a disability benefit appeal will be finalised for a person (details supplied) in County Mayo. [8163/01]

Payment of disability benefit was disallowed by a deciding officer following an examination by a medical assessor of my Department who considered that she was capable of work. The person concerned appealed this decision to the social welfare appeals office and, in that context she was examined by another medical assessor who was also of the opinion that she was capable of work. Her appeal has been considered by an appeals officer who has decided that an oral hearing of the appeal is necessary. This will be arranged as soon as possible.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.

473 Mr. Ring asked the Minister for Social, Community and Family Affairs the reason a person (details supplied) in County Mayo was refused the one parent family allowance. [8164/01]

The person concerned was refused one-parent family payment on 20 February 2001 as she had failed to supply necessary information sought by the Department.

The required information was supplied to the Department on 15 March 2001. A revised decision has been made on foot of this information and the claim has been awarded at the maximum rate with retrospective effect from 5 October 2000. Arrangements have been made to notify the person concerned and to deliver a payment book to her nominated post office for collection by her.
