Written Answers. - Hearing Impairment Claims.

122 Mr. N. Ahern asked the Minister for Defence if, regarding an Army deafness case (details supplied) he will clarify the status of the claim as the applicant understands his claim has been submitted by his solicitor several times, but has been told it has been referred back without explanation; if the situation can be clarified; if additional papers or medical opinion is required; if the claim has been rejected; and if a statement of explanation can be given. The person for whom details have been supplied instituted legal proceedings against my Department in December 1997. As the matter is therefore the subject of such proceedings, the Deputy will appreciate that I am not in a position to make any specific comments regarding the claim – and the person concerned would best be advised to consult with his solicitor in relation to the matters raised.

However, I can suggest that if the person concerned wishes to have his claim resolved under the early settlement scheme which has successfully resolved many hundreds of Army hearing loss litigation claims, he should ask his solicitor to contact the Chief State Solicitor's office in this regard.
