220 Mr. N. O'Keeffe asked the Minister for Agriculture, Food and Rural Development the position regarding an appeal by a person (details supplied) in County Kerry. [16655/01]

The notional herd average milk yield used to calculate the compensation entitlements of the person concerned under the brucellosis eradication scheme was based on the milk recording figure of 993 gallons for 1998 as supplied by his milk supplier on ER 79. This figure was more advantageous to the herd owner than the alternative which was 908 gallons based on the highest milk production over the qualifying period, I January to 20 September 1999, divided by the least cow number and with 100 gallons added for each qualifying cow.

Under the compensation arrangements, milk production figures in respect of the calendar years 1997 or 1999 cannot be used in calculating the notional herd average milk yield having regard to the date of the initial disease breakdown on 20 September 1999.
