402 Mr. Perry asked the Minister for the Environment and Local Government if he will waive the criteria for the written test in the case of a person (details supplied) as this person had a provisional licence but was unaware that the licence was the incorrect category; and if he will make a statement on the matter. [17025/01]

Under the Road Traffic Act, 1961, and the Road Traffic (Licensing of Drivers) Regulations, 1999 to 2001, it is a matter for the appropriate licensing authority, in this case Sligo County Council, to determine the eligibility of a person for a provisional driving licence and to issue licences. Representations in relation to the possibility of administrative error would also be matters to be raised with the appropriate local licensing authority.
