Michael Ring

Ceist:

108 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive a REP scheme payment. [20706/01]

An application for REPS 2 was received from the person named on 30 May. The application will be processed in accordance with the undertakings in the Protocol on Direct Payments to Farmers.

109 Mr. Crawford asked the Minister for Agriculture, Food and Rural Development when a farm grant payment will be made to a person (details supplied) in County Cavan; and if he will make a statement on the matter. [20707/01]

The scheme for the control of farm pollution has proved to be extremely successful and uptake has exceeded all expectations. The current ceiling for expenditure under this scheme has been reached and my Department has applied to the EU Commission for formal approval to raise the ceiling. A number of payments under the scheme, including payment to the person mentioned in the question, have been delayed temporarily pending receipt of formal approval from the EU. All payments, however, will issue immediately approval is received.

John Perry

110 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if he will intervene on behalf of a person (details supplied) and release a 2000 headage payment on land parcels; if he will authorise the removal of the land parcels that are causing payment difficulties; and if he will make a statement on the matter. [20708/01]

The background to this case is that the 1998 area aid application of the person named was originally cleared for payment with no errors, and various area aid related payments issued. Subsequently a dual claim emerged on two parcels following the processing of the area aid application of another herdowner. Entitlement to these two parcels was determined in favour of the other herdowner.

This resulted in an overclaim of some 8.27 hectares or 21.39% of the total area claimed by the person named. Under Article 9 of EU Regulation 3887/92, my Department has no option other than to apply a 100% penalty to the application when the overclaim on the area declared is greater than 20%. Therefore, in this case, an amount incorrectly paid of £11,755.11 in respect of the year 1998 must be recouped. A total of £4,307.91 was offset against his livestock applications in 2000, leaving the balance of £7,447.20 still to be recouped from future grants.

Austin Deasy

Ceist:

111 Mr. Deasy asked the Minister for Agriculture, Food and Rural Development the reason for the delay in issuing payment of REP scheme to a person (details supplied) in County Waterford; if he will ensure that there are no further delays; and if payment will issue promptly. [20768/01]

My Department was obliged to investigate an issue that had arisen in relation to an area of land which was included in the agri-environmental plan submitted by the person named. The matter has now been resolved in his favour and payment will issue to him before the end of July.

112 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive an extensification 2000 payment. [20769/01]

Payment of £571.78 under 2000 extensification premium will issue to the person named shortly. In addition, 2000 extensification premium euro compensation totalling £14.96 will also issue shortly.
