Written Answers. - Registration of Births.

Ceist:

631 Mr. Durkan asked the Minister for Health and Children when a person (details supplied) in County Kildare will receive a birth certificate; and if he will make a statement on the matter. [22446/01]

The birth to which the Deputy referred took place at home and is one to which the provisions of the Status of Children Act, 1987 applies. The Births and Deaths Registration Acts, 1863 to 1996, include provisions for the entry to paternity details in the register of births in respect of children born to parents not married to each other. Section 49 of the Status of Children Act, 1987, outlines the procedures to be followed and these include the registration of the father's details in the register of births on the joint application for registration by the parents, on the application by one or other parents with co-operation of the other parent or on the sole application of either the father or the mother of the child on the production of a certified copy of a court order naming the father of the child.

In the instance referred to by the Deputy, as three months have elapsed since the date of the birth of the child, the parents are required to make a statutory declaration setting out the details to be entered in the register of births. I understand that the registrar for births, deaths and marriages for the district concerned has provided the mother of the child with the necessary forms.
