188 Mr. P. Carey asked the Tánaiste and Minister for Enterprise, Trade and Employment if the case of a person (details supplied) in Dublin 11 will be re-examined under the Minimum Notice and Terms of Employment Acts, 1973 to 1991; and if she will make a statement on the matter. [21828/01]

There is no provision whereby the case under reference may be re-examined under the Minimum Notice and Terms of Employment Acts, 1973 to 1991. The particular case was the subject of a decision of the Employment Appeals Tribunal in July 2000, when an award of £300 was made.

Representations were made to my Department advising of non-payment to the employee concerned of the tribunal award. My Department followed up on these representations requesting payment to the employee of the amount due by the employer. The employee concerned subsequently advised my Department that payment of the award had not been received and the matter was referred to the Chief State Solicitor's office for advice.
Subsequently my Department was informed by the Chief State Solicitor's office to the effect that the matter cannot be pursued further because the employer appears to have ceased trading and has no assets against which a judgment may be enforced. As the particular company was dissolved in August 2000, it no longer constitutes a legal entity and in such a state cannot be made the subject of further legal proceedings.
