Vol. 543 No. 1

Written Answers. - Assisted Human Reproduction.

Ceist:

86 Dr. Upton asked the Minister for Health and Children the plans he has to introduce legislation to regulate surrogate parenthood; and if he will make a statement on the matter. [25611/01]

The subject of surrogacy raises a wide range of very sensitive and complex issues with associated legal, ethical, social and medical implications. In Ireland, surrogacy is not governed by any specific health legislation.

I am conscious of the degree of concern among the public about the absence of a statutory framework to regulate this area. With a view to addressing these concerns a Commission on Assisted Human Reproduction was established in 2000 and is currently preparing a report on the possible approaches to the regulation of all aspects of assisted human reproduction. This includes giving consideration to the issue of couples using surrogate births to start a family.

The commission comprises the medical, scientific and legal expertise necessary for a detailed and informed examination of the issues involved. The commission is required to consult with interested parties including philosophical and theological experts to ensure their perspectives are considered and reflected as appropriate. In addition, the commission recently placed advertisements in the public press inviting submissions from members of the public and other interested bodies including professional and voluntary organisations. The publication of the commission's report will provide the basis for informed public debate before the finalisation of any policy proposals.
