Ceist:

215 Mr. Neville asked the Minister for Agriculture, Food and Rural Development when an area based payment will be made to a person (details supplied) in County Limerick. [27495/01]

The animal based headage schemes have been replaced in 2001 by the area-based compensatory allowance scheme. A condition of the new scheme is that applicants must meet a minimum stocking level of 0.15 livestock units per forage hectare in the year preceding application. However, farmers who are unable to meet that minimum stocking density but who traditionally qualified for headage grants in respect of cattle and/or sheep may continue to qualify for payment, provided their land is being utilised and is not in danger of under grazing. The person named was not a headage recipient in 2000, and according to my Department's records, the stocking density of the holding does not meet the minimum requirement. My Department wrote to the person named on 7 November 2001 with a view to establishing the type of farming activity being pursued. A decision on entitlement to area-based compensatory allowance will be made on receipt of reply.

216 Mr. Neville asked the Minister for Agriculture, Food and Rural Development when an extensification premium payment will be made to a person (details supplied) in County Limerick. [27548/01]

Payable orders amounting to £1,173.48 (1,490.01), being the entire amount of 2000 extensification premium due to the person named, issued on 5 June and 29 June 2001.

The person named is also participating in extensification premium for 2001. Payment of the premium for 2001 is not scheduled to commence until June 2002.

217 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if he will waive all penalties imposed on an area aid application by a person (details supplied); and if he will make a statement on the matter. [27549/01]

The area aid unit has reviewed the circumstances of this application, and is prepared to accept the submission by Teagasc on behalf of the person named that a genuine error occurred. In these circumstances his 2001 area aid application has now been processed without penalty. Payment of his full entitlement under the 2001 area-based compensatory allowance scheme will issue shortly.
