The 2001 area aid application for the person named was randomly selected for inspection in accordance with EU regulations. This inspection will be carried out as soon as possible and when the results are returned to the area aid unit the application will be processed without delay. Payment due under the 2001 area-based compensatory allowance scheme will issue to the person named if the application is in order.

Ceist:246 Mr. Ellis asked the Minister for Agriculture, Food and Rural Development the reason an area-based payment was not made to a person (details supplied) in County Sligo; and if payment will be made. [28069/01]
The 2001 area aid application for the person named was randomly selected for inspection. The applicant applied for a total of 78.36 hectares. The area determined at inspection was 72.12 hectares which represents a difference of 6.24 hectares or 8.65%. Under Article 9 of EU Regulation 3887/92, the penalty is based on double the difference when the difference between the area claimed and the area found is between 3% and 20%. Therefore in this case a penalty of 12.48 hectares applies, leaving the area determined for payment purposes at 59.64 hectares. Payment of his entitlement under the 2001 area-based compensatory allowance scheme, based on 59.64 hectares, will issue shortly.

A parcel claimed by the person named is part of a commonage on which a cumulative overclaim has arisen. The area aid unit is currently seeking to clarify the correct entitlements to area aid on this commonage. It is hoped to have this exercise completed shortly. No payment under the 2001 area-based compensatory allowance scheme will issue to the person named until the matter is resolved.
