101 Mr. McGuinness asked the Minister for Health and Children if he has satisfied himself with the report on the investigation into allegations of assault on a person (details supplied) while an inpatient of a hospital in County Kilkenny; if he will consider the content of the report and the comments and views of the person's family; if he will reopen this case to allow this to happen. The allegation of assault on an in-patient to which the Deputy refers was the subject of an independent investigation in September 1999, the result of which was forwarded to my Department. The investigation committee concluded that there was insufficient evidence to substantiate the complaint made. After considering the report, I am satisfied that the committee carried out an appropriate investigation of the complaint made and reached a proper conclusion on the basis of its inquiries. In the circumstances, it is not deemed appropriate to reopen the investigation.
