Ceist:

134 Mr. Shatter asked the Minister for Justice, Equality and Law Reform if he proposes to reform the law to allow for the recognition of a foreign divorce granted by the courts of the state of which both spouses are nationals; and if he will make a statement on the matter. [28410/01]

Under Council Regulation (EC) No. 1347/2000, which applies in the member states of the European Union with the exception of Denmark, with effect from 1 March last, divorce decrees granted by the courts of the member state of the nationality of both spouses, or, if the state is the UK, the domicile of both spouses, are recognised here. The question of legislation to deal with recognition of divorce judgments given in countries outside the European Union in the future is being considered within my Department. I have no plans for legislation to retrospectively amend the rules which govern generally the recognition of foreign divorces.
