176 Mr. Crawford asked the Minister for Agriculture, Food and Rural Development when payments of headage and other payments will be made to a person (details supplied) in County Monaghan; and if he will make a statement on the matter. [29190/01]

Under the terms and conditions of the 2001 area aid scheme, an applicant must ensure that only eligible land is included on the area aid application. The person named included one ineligible area in her area aid application, comprising of buildings, trees or other invalid land totalling some 0.28 hectares.

The herdowner applied for area aid in respect of a total of 19.29 hectares, but after deducting the ineligible land, a valid area of 19.01 hectares has been determined, which is 1.45% less than the area claimed. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. In this case, therefore, no area aid penalty is applicable, leaving the area determined for payment purposes at 19.01 hectares.

Payment amounting to £1,211.94 under the 2001 area-based compensatory scheme issued to the person named on 25 September 2001 in respect of 5.46 hectares of more severely handicapped land at £70 per hectare, and 13.83 hectares of less severely handicapped land at £60 per hectare. This compares with her average payment of £1,046.55 in the three years 1998, 1999 and 2000. However, she was due payment on 13.55 hectares of less severely handicapped land at £60 per hectare resulting in an overpayment of £16.80 on the difference of 0.28 hectares. The overpayment will be recouped from future entitlements of the person named.

Payment of the 80% advance under the 2001 suckler cow premium scheme, amounting to £1,688.51, 2,143.96, will issue to the person named within the next seven days.

The person named submitted three applications in respect of a total of 14 animals for special beef premium under the 2001 scheme. Payment of the 80% advance under the 2001 special beef premium scheme amounting to £1,199.52 will issue within the next two weeks.

There are no payments due to the person named in respect of the slaughter premium scheme for 2000 or 2001.
