Ceist:

145 Mr. Broughan asked the Minister for the Environment and Local Government when sections 133 and 146 of the Local Government Act, 2001, will be brought into operation by regulations; and if the comparable sections of the City and County (Management) Act, 1955, still have force of law. [29380/01]

I intend that these sections will be brought into operation by way of commencement order to be made next month. While the corporate policy groups envisaged by section 133 of the Local Government Act, 2001 are, therefore, not yet formalised by statute, my Department has advised local authorities to involve these groups in the preparation of estimates for 2002, in anticipation of the new legislative provisions. The provisions of the City and County Management (Amendment) Act, 1955, relating to estimates committees have already been repealed.

Existing legislative provisions relating to the office of manager continue to apply pending the activation of section 146 and other relevant provisions of the Local Government Act, 2001.

146 Mr. Broughan asked the Minister for the Environment and Local Government the sections of the Local Government Act, 2001, which have been brought into operation by regulation. [29381/01]

The provisions of the Local Government Act, 2001 are being brought into operation on a phased basis by way of a series of commencement orders as necessary preparations are completed. The first commencement order – S.I. No. 458 of 2001 – was made last month and laid before both Houses. Articles 2, 3 and 4 and the schedule to that order set out the provisions of the Act which it brings into operation and the relevant dates of commencement. It is the intention that the next order will be made next month and will bring major portions of the Act into operation from 1 January, 2002. Local authorities have been notified of the position.
