68 Mr. Ring asked the Tánaiste and Minister for Enterprise, Trade and Employment the reason the Health and Safety section of her Department has not recommended the type of fencing required to be erected by quarry owners in Partry, Claremorris, County Mayo, as a result of a court order issued instructing it to do so. [31457/01]

The national authority for occupational safety and health – Health and Safety Authority – is the national body charged with overall responsibility under the Safety, Health and Welfare at Work Act, 1989 for the administration, enforcement and promotion of the relevant statutory provisions on occupational safety and health. Compliance with occupational health and safety law is a day-to-day matter for the authority. In particular, the specific type of action referred to in Deputy Ring's question is concerned with the exercise, by the authority's inspectorate, of its investigative and enforcement powers in which I have no role or function.

The matter raised in Deputy Ring's question should be taken up directly with the Galway office of the Health and Safety Authority. This office is located at Odeon House, Eyre Square, Galway, telephone (091) 563985.

In the meantime I have brought Deputy Ring's question to the attention of the Health and Safety Authority and I have asked the authority to reply directly to Deputy Ring on the matter.
