312 Mr. Killeen asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Clare will be adequately compensated for the care of a stray animal over the past three years when the animal is sent to the factory at the behest of his Department. [1934/02]

The position is that my Department regards the herdowner concerned as the owner of the animal in question. I understand that the original identification of the animal is not available and the herdowner has not been able to properly identify it. EU and national legislation requires that in such cases the animal is destroyed at the owner's expense without any compensation.
