705 Mr. Kenny asked the Minister for the Environment and Local Government the monitoring systems in place to ensure that only smokeless fuel products are on sale in designated smokeless zones; and if he will make a statement on the matter. [2823/02]
Responsibility for enforcement of the Air Pollution Act, 1987, (Marketing, Sale and Distribution of Fuels) Regulations, 1998 and 2000, rests with the relevant local authorities.
Enforcement by local authorities is undertaken by a range of means including inspections, taking of samples for analysis, issuing of warning notices and the taking of prosecutions where necessary. Guidance on enforcement best practice was circulated to relevant local authorities by my Department in September 2000.
