949 Mr. G. Mitchell asked the Minister for Justice, Equality and Law Reform if it is intended to pay compensation to a person (details supplied) in Dublin 8 following alleged damage to property during a Garda raid. [1630/02]

I have been advised by the Garda Commissioner that a search of the property of the person concerned was carried out and that items of stolen property were recovered during the course of the search. The commissioner has advised me that because they were denied entry to the property, the gardaí involved were obliged to use force resulting in property damage. The commissioner also states, however, that no unnecessary force was used and no unnecessary damage was caused. In the circumstances, no basis has been identified on which a liability to make a compensation payment could be said to arise.
