Ceist:

956 Mr. Perry asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 180 of 18 October 2001, he will indicate the progress which has been made on an application by a person (details supplied) in County Sligo for section 49 registration of title; and if he will make a statement on the matter. [1787/02]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49, that is acquisition of title by virtue of long possession, of the Registration of Title Act, 1964, which was lodged on 20 March 2000 – dealing No. D2000SM002199R refers. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, can take some time to process. Accordingly it is not possible to estimate a completion date at this stage.

However, I am further informed that queries issued to the lodging solicitors on 26 October, 2001 and that a reply was received on 30 November, 2001. I assure the Deputy that the application is receiving attention in the Land Registry and once all outstanding queries have been satisfactorily dealt with the matter will be brought to a conclusion as quickly as possible.
