1037 Mr. Kenny asked the Minister for Justice, Equality and Law Reform if his attention has been drawn to an article carried in a publication (details supplied) which indicates that a candidate in the forthcoming Dáil general election was in a position to remove anti-social behaviour from a housing estate and to put in place other arrangements in respect of joyriding and access to drugs; his views on the implications of this matter; if he has discussed the situation with gardaí in the town in question; if he considers that the reports of removal of anti-social behaviour were carried out by members of a private army; and if he will make a statement on the matter. Whenever the Garda Síochána receive a complaint or otherwise become aware of alleged or suspected criminal activity, the matter is thoroughly and speedily investigated. Where sufficient evidence of the commission of such criminal activity is adduced, criminal proceedings ensue.

I am informed by the Garda authorities that they are aware of a number of incidents of suspected vigilantism in the area in question and these are being actively investigated. An incident room has been established to co-ordinate the investigation. Evidence has come to light indicating the involvement of particular individuals. However, sufficient evidence has not yet been obtained to ground a criminal prosecution. When sufficient evidence is available, a file will be submitted to the Director of Public Prosecutions.
