Ceist:

1218 Mr. Aylward asked the Minister for Education and Science, further to parliamentary Question No. 777 of 6 November 2001, the progress which has since been made on this matter. [1737/02]

The legislation providing for the implementation of EU Directive 97/81/EC of the Council of the European Union concerning the Framework Agreement on Part-Time Work was enacted in December 2001.

My Department will be conducting discussions with the relevant interests with a view to implementing the terms of this legislation in so far as it affects temporary teachers.

1219 Mr. Aylward asked the Minister for Education and Science if he will approve the appointment of a third teacher to a national school (details supplied) in County Kilkenny. [1739/02]

1299 Mr. Hogan asked the Minister for Education and Science if he will appoint a third teacher for a school (details supplied) in County Kilkenny in September 2002; and if he will make a statement on the matter. [2361/02]

(Dr. Woods): I propose to take Questions Nos. 1219 and 1299 together.
The staffing of a primary school is determined by reference to the enrolment of the school on 30 September of the previous school year. This is in accordance with guidelines agreed between the Department and the education partners.
The enrolment at the school in question was 44 pupils on 30 September 2000, which warrants the staffing of a principal and one mainstream class teacher for the current school year. According to data submitted to my Department by the board of management the enrolment on 30 September 2001 was 48 pupils. The staffing schedule for the 2002-03 school year has not yet been determined.
The board of management of the school will be advised of the staffing position for the 2002-03 school year by circular letter in the near future. The school also has the services of a shared learning support teacher.
