Ceist:

312 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform the reason a per son (details supplied) in the United Kingdom was not notified by the Garda Síochána in Galway of a court date for a case which subsequently was thrown out on grounds that witnesses did not turn up; and if he will make a statement on the matter. [3177/02]

I am informed by the Garda that this issue is the subject of a complaint by the named individual under the Garda Síochána (Complaints) Act, 1986. The Garda Síochána Complaints Board is the statutory, independent body responsible for the investigation and adjudication of complaints in relation to Garda conduct and I am sure the Deputy will appreciate that, in the circumstances, it would not be appropriate for me to make any comment on the matter.
