Ceist:

86 Mr. Gormley asked the Tánaiste and Minister for Enterprise, Trade and Employment the reason she did not act against violations of the Companies Act, 1963, by individuals trading as a company (details supplied), despite being given the information and documentation over a year ago; and if she will make a statement on the matter. [3122/02]

Following the establishment of the Office of the Director of Corporate Enforcement on 28 November 2001, the matter referred to the Deputy now falls within the responsibility of the Director of Corporate Enforcement.

I regret the matter has not yet been finalised. I have asked the director to see what can be done to expedite the matter and, in any event, to inform the individual who brought the matter to our attention of the current position.

Under the Company Law Enforcement Act, 2001, the director is independent in the discharge of his duties and is not in a position to provide details of individual cases under consideration.
