100 Mr. B. Smith asked the Minister for Agriculture, Food and Rural Development when a depopulation payment will issue to a person (details supplied) in County Cavan; and if he will make a statement on the matter. [5124/02]

It was not possible for the local district veterinary office to process the compensation due under the on-farm market valuation scheme until the factory invoices were received from the person concerned. These were not supplied by him until 29 January.

The appropriate valuation differential payment and depopulation grants have been processed for all but two of the animals removed. Payment will issue very shortly. Payment for the two remaining animals will issue when the outstanding queries have been satisfactorily resolved.

101 Mr. B. Smith asked the Minister for Agriculture, Food and Rural Development the proposals to increase the payment per hectare on mountain type land under the new area based compensatory allowance scheme; and if he will make a statement on the matter. [5125/02]

The area based compensatory allowance scheme, agreed in July 2000 and approved by the European Commission in the context of the CAP rural development plan, provides for area related payments as follows: more severely handicapped (lowland) –€88.88, £70, per hectare up to 45 hectares; less severely handicapped (lowland) –€76.18, £60, per hec tare up to 45 hectares; and mountain type land –€57.14, £45, per hectare up to 60 hectares.

Following a thorough review of the area based compensatory allowance scheme, proposals have been submitted to the European Commission for increased payment rates for farmers with mountain type land. The proposal involves making a payment of €101.58 or £80 per hectare on the first ten hectares of mountain type land. There would also be a payment of €88.88 or £70 per hectare on each remaining hectare, subject to an overall payment ceiling of 45 hectares. Subject to securing the necessary EU approval it is intended that the revised payment rates will apply from 2001.

The area aid application details in respect of the person named are currently being entered on the Department's electronic database. When this is complete any area aid related payments will be made.
