Ceist:

295 Mr. Bradford asked the Minister for the Environment and Local Government his views on correspondence (details supplied) regarding a driving test; and if he will make a statement on the matter. [6510/02]

The person concerned attended for a driving test on 14 January 2002. The report prepared by the driver tester indicated that she made a number of serious driving errors during the course of the test. The decision of the tester was that she did not meet the required standard to enable her to pass the test. As a gesture of goodwill in this case, my Department has indicated that the individual on reapplication for a test be offered a test by a senior tester. A person aggrieved by the decision of a driver tester may appeal to the District Court under section 33 of the Road Traffic Act, 1961. If the court finds that the test was not properly conducted it can direct that a further test be arranged free of charge for the candidate concerned.
