478 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform the status of an asylum application by a person (details supplied). [7496/02]

I refer the Deputy to my replies to Questions Nos. 141 and 314 of 31 May 2001 and 5 February. The judicial review proceedings instituted by the person in question are currently before the courts. Therefore, it would be inappropriate for me to comment further.

I refer the Deputy to my reply to Question No. 125 of 21 February. At present the case of the family in question is under consideration and I expect the file to be submitted to me shortly.

483 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform if he has received an asylum application from the family of a person (details supplied) in County Galway. [7501/02]

The Deputy is referring to family reunification applications in respect of the two children of the person in question. These applications have been approved and the person in question was advised of this in a letter from my Department which issued on 28 February.

484 Mr. Howlin asked the Minister for Justice, Equality and Law Reform the status of an application for asylum by persons (details supplied) in County Waterford; if permission for this family to remain here on humanitarian grounds is being considered; and if he will make a statement on the matter. [7502/02]

The family in question arrived in the State on different dates, the mother and three daughters on 8 October 1999 and her husband on 4 November 1999. Their claim was refused by the Refugee Applications Commissioner on 7 September 2000. They were notified of the decision on 11 September 2000. The applicants appealed this decision on 21 September 2000. On 27 November 2001 the Office of the Refugee Appeals Tribunal rejected their appeal. They were notified of this decision on 11 December 2001.

In accordance with section 3 of the Immigration Act, 1999, the family were informed on 21 January that it was proposed to make deportation orders in their case. They were given the alternatives of either making representations within 15 working days setting out the reasons they should be allowed to remain temporarily in the State, leaving the State before the orders are made or consenting to the making of deportation orders. Representations have been received as to why they should be allowed remain in the State and I expect the case file to be submitted to me for decision shortly.
