John Perry

219 Mr. Perry asked the Minister for Agriculture, Food and Rural Development further to Parliamentary Question No. 156 of 19 February 2002, the position regarding a 2001 suckler cow payment to a person (details supplied); if he will have the CMMS database updated in view of the mart register (details supplied) outlining the date of sale to ensure that this person's 2001 suckler cow payment can now be issued; and if he will make a statement on the matter. The person named applied for premium for seven animals under the 2001 suckler cow premium scheme. He has been paid his full entitlement under this scheme.

220 Mr. Perry asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) will receive his area aid payment; the reason for the delay; and if he will make a statement on the matter. [8668/02]

As stated in my reply to Parliamentary Question No. 360 of 30 January 2002 the person named submitted an incomplete 2001 area aid application in that he had omitted to send in a map for new parcels of land on which he is claiming area aid. He subsequently furnished maps and these have now being entered on the Department's electronic database.

The person named applied on 78 animals under the 2001 suckler cow premium scheme. At an inspection, carried out on his herd on 13 November 2001, it was not possible to establish if his holding and that of his wife were managed separately. Furthermore, 23 problems were found with identification and registration requirements for animals inspected. My Department wrote to the person named on 22 February 2002 setting out the inspection findings and advising that both herds would be amalgamated for the purposes of payments of premium in 2001; that one application under each of the livestock premia schemes should be submitted in future; that one animal with no tag would be deleted from his claim, two other animals with no tags and an absent animal would be rejected and a reduction in payment of 2.34%, in accordance with the terms and conditions governing the scheme, would apply to the payment in respect of his eligible animals under the amalgamated 2001 suckler cow premium applications. The person named was also advised that he could have this decision reviewed by writing to my Department, within 21 days, setting out any facts which have not already been made known to my staff. To date no reply has been received from the person named.

The person named has made two applications in respect of special beef premium on 20/12/01 and 21/12/01 in respect of 21 animals. The applications were selected for inspection. It was noted that one animal from the latter application was absent without explanation on the day of the inspection. This animal will be deleted and a reduced payment will apply on the remaining eligible animals. However, the recommendation at the suckler cow inspection of 13/11/01 that this herd number and that of his wife be amalgamated for premium purposes has to be implemented prior to processing of payment of special beef premium. The person named was notified of the decision on 22/02/02 and given 21 days to have that decision reviewed and has made no application for review to date.

Advance payment under the slaughter premium scheme 2001, to the amount of €1,102.40 has issued to the person named in respect of 26 animals. One of these animals also qualified for the additional national envelope slaughter premium top-up advance of €18.28.

As maximum payment has already issued under the 2001 area-based compensatory allowance scheme to the wife of the person named no further payment is due to the person named under that scheme.

221 Mr. Perry asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) will receive a REP scheme payment; the reason for the delay; and if he will make a statement on the matter. [8669/02]

This application was received on 26 February 2002 and is being processed in accordance with the targets set out in the protocol on direct payments to farmers.

222 Mr. Penrose asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Westmeath has not had their area aid application duly processed to date; if the problem in relation to same arises due to the change in computer technology being effected at head office level and that same has now caused this person's payments to be stopped; and the steps he will take to ensure that same is now sorted out; and if he will make a statement on the matter. [8731/02]

The person named included 46.91 hectares in his 2001 area aid application. An area of 46.05 hectares was determined which is some 0.86 hectares or 1.87% less than the area claimed.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. Therefore, in this case no area aid penalty has been applied, leaving the area determined for payment purposes at 46.05 hectares. Payment of his full entitlement under the 2001 area-based compensatory allowance scheme has issued to the person named.

The person named submitted two applications for special beef premium on 25 October 2001 and 13 December 2001. The 25 October 2001 application has been processed and now that the area aid problem has been resolved, payment will issue within the next two weeks. The 13 December 2001 application has been processed and payment is scheduled to issue at the end of March 2002 provided the terms and conditions of the scheme have been observed.

The resolution of the area aid problem has also facilitated clearance of the final instalment of the 2001 ewe premium and a payable order will issue shortly.

The person named applied for premium for 31 animals under the 2001 suckler cow premium scheme. His 80% advance entitlement issued on 26 October 2001. Balance payments commenced issuing on the 31st January 2002. At that time area aid details concerning the person named reflected a 100% over declaration penalty resulting in the advance payment of suckler cow being deemed an overpayment. As the area aid matter has now been resolved in favour of the person named any monies recouped in respect of the suckler cow overpayment will be refunded within the next fortnight and the 20% balance payment under this scheme will be paid as soon as possible.

223 Mr. Hogan asked the Minister for Agriculture, Food and Rural Development the amount of premia for various schemes that have been paid to a person (details supplied) in County Kilkenny; when outstanding payments will be made; and if he will make a statement on the matter. [8761/02]

Advance payment under the 2001 slaughter premium scheme totaling €424.00 issued to the person named on 4 January 2002 in respect of ten animals. Any balancing payments will be offset against an overpayment under his REP scheme application. The person named made no 2000 or 2001 special beef premium applications.

The person named applied for premium for ten cows under the 2000 suckler cow premium scheme. His 60% advance payment for £884.34 and 20% supplementary advance for £294.78 were recouped to offset against the overpayment under his REP scheme. Under the 2001 area based compensatory allowance scheme, €1555.35 was paid on 3 October 2001 and the balance €1497.18 was offset against his outstanding REPS payment. The person named applied for premium for ten animals under the 2001 suckler cow premium scheme. He has been paid €564.33 to date and the balance will be offset against the outstanding REPS overpayment.
