491 Mr. Hogan asked the Minister for the Environment and Local Government if he will introduce new legislation which will lay down the criteria and guidelines under which waste management and planning decisions are made by local and national statutory bodies; and if he will make a statement on the matter. [9070/02]

Section 257 of the Planning and Development Act, 2000 incorporates new provisions on planning control of waste facilities. It empowers a planning authority or An Bord Pleanála to refuse planning permission for a waste facility, which requires a waste licence from the EPA, where it considers the development is unacceptable on environmental grounds, having regard to the proper planning and sustainable development of the area. Following the enactment of the 2000 Act, I have no further proposals for amendment of the planning code.

In the context of the forthcoming Environmental Protection Agency (Amendment) Bill, the general scheme of which has been approved by the Government, I intend, to propose further amendments to the Waste Management Act, 1996, in respect of a range of waste issues.
