Written Answers. - European Arrest Warrant.

Ceist:

593 Mr. O'Shea asked the Minister for Justice, Equality and Law Reform if the possibility of seeking the extradition of those wanted for questioning in regard to the Dublin and Monaghan bombings has been explored in view of the new EU extradition arrangements; and if he will make a statement on the matter. [8629/02]

I presume the Deputy is referring to the proposed Council framework decision on the European arrest warrant.

The framework decision, which is due to be adopted by Council shortly and scheduled to become fully operational in January 2004, will require legislative change in this jurisdiction but it is in any event the case that there is provision under existing law for the extradition of persons for trial for murder.

The Deputy will be aware of course that the Dublin and Monaghan bombings are currently the subject of an inquiry by Mr. Justice Henry Barron, and it is also the case that the Garda investigation into the bombings remains open.
