Tom Hayes

Ceist:

128 Mr. T. Hayes asked the Minister for Agriculture, Food and Rural Development when payment of a 2001 suckler premium will be made to a person (details supplied) in County Tipperary for 105 animals. [11000/02]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): The person named applied for premium on 60 animals under the 2001 suckler cow premium scheme. Following an inspection it was found that one animal was not in the applicant's ownership and possession on the date of application and one animal was found to be of an incorrect sex. As a result these two animals were rejected from the claim with a resultant penalty to be applied to the remaining eligible animals. In processing the application further it was found that animals submitted as replacements were in fact part of the original application and were therefore not eligible replacements. My Department has been in contact with the person named regarding these matters and is currently endeavouring to acquire the tag numbers of suitable replacements. When this matter is resolved the application will be processed further.
The 2001 suckler cow premium application for 45 animals submitted by the late husband of the person named has been fully processed and payment in full issued on 8 April 2002.

129 Mr. T. Hayes asked the Minister for Agriculture, Food and Rural Development when payment under the 2001 suckler grant premium scheme will issue to a person (details supplied) in County Tipperary. [11001/02]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): The person named applied for premium for 30 animals under the 2001 suckler cow premium scheme. He was informed on 9 August 2001 that his application was received on 29 May 2001 and that the first day that he could sell or dispose of an animal was 30 November 2001. An advance payment based on these animals issued on 26 October 2001. In processing the application for the balancing payment it was found that four animals were disposed of inside the six months retention period and were not replaced in accordance with the terms and conditions of the scheme.
The herd owner was informed on 18 February 2002 that the four animals in question were to be rejected from the application with a reduction penalty to be applied to the 26 remaining eligible animals. He appealed this decision by contacting my Department. The person named has been informed however that the decision as outlined in the correspondence of 18 February stands and that the application is being processed on this basis. He has been advised that he can have this decision reviewed by contacting my Department within 21 days with any new evidence that may assist his appeal.

130 Mr. T. Hayes asked the Minister for Agriculture, Food and Rural Development when a 2001 area aid payment will issue to persons (details supplied) in County Tipperary. [11002/02]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): The persons named submitted an incomplete area aid application in that they included two parcels but did not supply the correct land parcel identification number. The details of the two parcels concerned have now been entered on the Department's electronic database. Any area linked payments due will issue shortly.

Jack Wall

131 Mr. Wall asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Wicklow will receive payment of an installation aid scheme grant; and if he will make a statement on the matter. [11003/02]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): Under the terms and conditions of the scheme of installation aid applicants must fulfil the training and educational requirements at the date of setting up or at the latest within two years from that date. The person named was set up in 1995. As the necessary level of training was not achieved until the year 2000 the applicant is ineligible for aid under the scheme.

132 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) can have a dairy hygiene grant payment immediately released; and if he will make a statement on the matter. [11004/02]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): An application under the old dairy hygiene scheme was received from the person named on 27 September 1995. A pre-approval inspection was carried out, but the application could not be processed further as the necessary planning permission was not received. The current dairy hygiene scheme has replaced this scheme and it is open to the person named to submit an application if he meets the terms and conditions of the new scheme.

133 Mr. Hogan asked the Minister for Agriculture, Food and Rural Development if he will review the penalty being imposed on a special beef premia of a person (details supplied) in County Kilkenny; and if he will make a statement on the matter. [11005/02]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): The person named submitted three applications under the 2001 special beef premium scheme in respect of a total of 39 animals. Advance payment has issued in respect of 21 animals listed on the first two applications. The third application, which was submitted on 21 December 2001 in respect of 18 animals was selected for an on-farm inspection at which it was found that one of the animals listed was a female. This animal was rejected from the application and a penalty of 5.8% was applied on the remaining 17 animals. The person named has sought a review of the case and will be informed of the outcome of the review as soon as possible. Balancing payments are due to issue during April.

Charles Flanagan

Ceist:

134 Mr. Flanagan asked the Minister for Agriculture, Food and Rural Development the reason for the delay in dealing with a suckler cow application, special beef premium and livestock premium in respect of a person (details supplied) in County Laois. [11006/02]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): The person named included a land parcel on his 2001 area aid application, which overlapped with that of another herd owner. Both herd owners were contacted in this regard and the matter has been resolved in favour of the other herd owner. The area aid application from the person named has now been fully processed and an area of 112.10 hectares has been determined for payment purposes.
The person named applied for premium on 61 animals under the 2001 suckler cow premium scheme. His full entitlement was paid on 8 April 2002 based on 60.8 animals, which is his suckler cow quota limit.
The person named made three applications in respect of special beef premium 2001, on 23 May 2001, 9 July 2001 and 29 November 2001 in respect of a total of 28 animals. Advance payment issued on 11 April 2002, in respect of 27 animals. Payment on the remaining animal – tag no. 221138040085 – was delayed pending clarification of a movement record on the cattle movement monitoring system. This has now been resolved and payment will issue with balancing payments at the end of April.
Advance payment in respect of the slaughter premium 2001 has issued to the person named in respect of 20 animals including an additional national envelope top-up payment in respect of one heifer slaughtered. Balancing payments on slaughter premium and national envelope 2001 scheme will issue next month when the national quota position is finalised.
