John Perry

172 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if, further to Parliamentary Question No. 244 of 20 March 2002, he will rescind the decision made by his Department; and if he will make a statement on the matter. [11457/02]

The herd owner lodged an appeal regarding the late submission of his 2001 area aid application. Following a full examination of this case the headage and premium appeals unit found that the decision taken by the area aid unit was correct and consequently the appeal was unsuccessful. The updated medical evidence submitted subsequently has now been considered and the headage and premium appeals unit has indicated that it does not represent sufficient grounds to overturn the original decision.

173 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when a reactor compensation payment will be made to a person (details supplied) in County Kerry following a brucellosis breakdown in their herd in 1998; and if he will make a statement on the matter. [11458/02]

My Department is not satisfied that the person concerned complied with the provisions of the Diseases of Animals Act, 1966 and the relevant brucellosis orders of 1991 and 1998. Consequently, my Department is currently in direct correspondence with solicitors representing the person concerned with regard to the non-payment of compensation arising from the depopulation of the herd.

174 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive the remainder of a suckler cow premium for 2001. [11459/02]

The person named applied for premium on 18 animals under the 2001 suckler cow premium scheme. She has been paid her full entitlement under this scheme. An advance payment issued on 26 October 2001 with a balancing payment on 8 April 2002.

175 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) will receive full compensation payment for a tuberculosis reactor animal; and if he will make a statement on the matter. [11463/02]

A cheque for the balance of the net differential payment due to the person concerned under the on-farm market valuation scheme is now being issued.

176 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive a first year REP scheme 2 payment. [11486/02]

The IMPACT union had withdrawn its co-operation in respect of the processing of all REP scheme applications in all FDS offices throughout the country on the basis that a satisfactory solution to the implementation of the recommendations of a report carried out by the management services division of my Department on the staffing in the technical agricultural officer grades of the farm development service areas had not been finalised.

I am pleased to say that the industrial action has been suspended from this morning. This suspension allows the Labour Relations Commission to intervene in the matter.

The protocol on direct payments to farmers sets specific processing and payment targets for REP scheme payments. As a consequence of the industrial action, my Department will not now be able to achieve these targets in a number of cases; however, all outstanding REP scheme payments applications will be processed as a matter of urgency.

177 Mr. Timmins asked the Minister for Agriculture, Food and Rural Development the position regarding a person (details supplied) in County Wicklow who is waiting to be paid a 2001 suckler cow grant; when payment will be made; and if he will make a statement on the matter. [11504/02]

The person named applied for premium on 34 animals under the 2001 suckler cow premium scheme. He has been paid his full entitlement under this scheme. Payment was issued on 10 April 2002.

178 Mr. Timmins asked the Minister for Agriculture, Food and Rural Development the position regarding a person (details supplied) in County Wicklow who had money stopped out of their suckler cow payment and their slaughter payment; the reason this was stopped; and if he will make a statement on the matter. [11505/02]

The person named applied for premium for five cows and one heifer under the 2001 suckler cow premium scheme. An advance payment based on six animals was paid to him on 18 December 2001. Area aid records show that the applicant has a forage area of less than 7.5 hectares. He is therefore entitled to premia payments on a maximum of 15 livestock units. As the person named has now been paid on 11.4 special beef premium livestock units, calculations at balancing payment stage under the suckler cow scheme show 3.6 livestock units eligible for payment. The amount due was recalculated based on three cows and one heifer under two years. As a result part of the advance payment was deemed overpaid and has since been recovered from payment due under the slaughter and beef premium schemes.

Advance payment was authorised to the person named in respect of nine animals for slaughter premium 2001 amounting to €381.61.

Payments for the amounts €212 and €84.81 were issued on 24 October 2001 and 18 December 2001 respectively. The remaining amount of €84.80 was offset against the overpayment which occurred on the suckler cow premium scheme for 2001.
