194 Mr. Crawford asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Monaghan can expect to receive a bull premium payment; and if he will make a statement on the matter. [11643/02]

The person named applied for premium on 42 animals under the 2001 suckler cow premium scheme. He has been paid his full entitlement based on 40.7 animals, which is his suckler cow quota limit. An advance payment issued on 9 January 2002 with a balancing payment on 25 March 2002. The person named submitted two applications in June and October for special beef premium 2001 in respect of a total of 28 animals.

Advance payment of 80 % has issued in respect of 17 animals. Following the clarification of a number of cattle movement monitoring system (CMMS) issues, payment in respect of the remaining 11 animals will be issued shortly.

Paul Connaughton

Ceist:

195 Mr. Connaughton asked the Minister for Agriculture, Food and Rural Development when a 2001 suckler cow grant payment will be made to a person (details supplied) in County Galway; and if he will make a statement on the matter. [11652/02]

The person named included four land parcels on his 2001 area aid application which were also claimed by another herd owner. Both herd owners were written to and the matter was resolved in favour of the other herd owner. The person named applied for a total area of 60.05 hectares but an area was found of only 47.92 hectares. This resulted in an area over-claim of 12.13 hectares or 25.3%.

Under the EU regulations, no penalty is applied when the over-claim is less than 3%, the penalty is based on double the difference when the over-claim is between 3% and 20% and when the over-claim is greater than 20%, a 100% penalty must be applied. Therefore in this instance, a 100% penalty applies and no area aid linked payments, including suckler cow grants, can issue to the applicant.

196 Mr. Connaughton asked the Minister for Agriculture, Food and Rural Development the reason an area based payment for 2001 has not issued to a person (details supplied) in County Galway; and if he will make a statement on the matter. [11653/02]

The person named included a land parcel on his 2001 area aid application on which an area over-claim arose. The herd owner applied for a total area of 11 hectares but an area was found of only 10.37 hectares. This resulted in an area over-claim of 0.63 hectares or 6%.

Under the EU regulations, no penalty is applied when the over-claim is less than 3% and the penalty is based on double the difference when the over-claim is between 3% and 20%. Therefore in this instance, an area aid penalty of double the difference between the area found and the area claimed must be applied leaving an area determined for payment purposes of 9.11 hectares. Payment due under the 2001 area-based compensatory allowance scheme will issue within the next two weeks.
