462 Ms O'Sullivan asked the Minister for the Environment and Local Government if his attention has been drawn to the lack of action taken to remove illegally dumped animal waste material at Mountpelier, County Limerick, despite ongoing investigations by the EPA and Limerick County Council; if he will intervene to get a resolution to the situation; and if he will make a statement on the matter. Under section 59 of the 1996 Act, each local authority is responsible for the supervision and enforcement of the relevant provisions of the Act in relation to the holding, recovery and disposal of waste within its functional area. Neither functions of this kind, nor those relating to the investigation of unauthorised waste activities have been conferred on the Minister for the Environment and Local Government. However, the matter in question is currently the subject of discussions between the Limerick County Council, the Environmental Protection Agency and the Department of Agriculture, Food and Rural Development with a view towards finding an early resolution in accordance with relevant statutory requirements.
