Ceist:

129 Mr. Higgins (Dublin West) asked the Minister for Justice, Equality and Law Reform if he will make a statement on the Supreme Court ruling on whether politicians are entitled to inquire into the nature of the Garda operation at Abbeylara, County Longford, in April 2000, which resulted in the fatal shooting by gardaí of Mr. John Carthy. [11857/02]

Last week's Supreme Court ruling obviously has wider implications than those applying to the sub-committee's inquiry which need to be examined. The Deputy will appreciate that the judgments were lengthy, detailed and complex and reaching conclusions in relation to what action might need to be taken will inevitably take time.

While the Oireachtas inquiry into the fatal shooting of Mr. John Carthy at Abbeylara cannot now proceed, the Oireachtas is in the process of establishing a public inquiry under the Tribunals of Inquiries (Evidence) Acts, 1921 to 2002, into the facts and circumstances surrounding Mr. Carthy's death.
