331 Mr. Perry asked the Minister for Agriculture and Food the reason a person (details supplied) in County Sligo has not received a correct area aid payment for 2001 and 2002 based on the satellite maps which were submitted; if his Department will intervene on this person's behalf to ensure a full payment is released; and if he will make a statement on the matter. [16288/02]

The person named included a land parcel on his 2001 area aid application to which he was not entitled. He claimed a total of 15.46 hectares but was entitled to claim only 13.82 hectares. This resulted in an overclaim of 1.64 hectares or 11%.

Under the EU regulations, no penalty is applied when the overclaim is less than 3%. The penalty is based on double the difference when the overclaim is between 3% and 20%. Therefore in this instance, an area aid penalty of double the difference between the area found and the area claimed must be applied leaving an area determined for payment purposes of 10.54 hectares.

Payments due under the 2001 area-based compensatory allowance scheme, 2001 suckler cow premium scheme, 2001 special beef premium scheme and 2001 extensification premium based on 10.54 hectares will issue shortly.

The 2002 area aid application of the person named was fully processed with an area determined for payment purposes of 18.66 hectares. The person named was paid his full entitlement under the 2002 area-based compensatory allowance scheme on 27 September 2002. Payments under the 2002 premia schemes are not due to commence until 16 October 2002.
